1. Introduction
Welcome to My Carnival Match, an online marketplace that facilitates the resale of event tickets and costumes between third-party sellers and buyers. By accessing or using our platform, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please refrain from using our services.
2. User Eligibility
To list or purchase items on My Carnival Match, you must be at least 18 years old and capable of entering into legally binding agreements. Users are required to verify their identity through our designated verification process to ensure the integrity and security of transactions.
3. Listing and Fees
- Listing Fee: Each item listed incurs a non-refundable fee of $4.99 per listing.
- Approval Process: Listings are subject to review and will be published within 24 to 48 hours after submission.
- Per Sale Fee: A 7% fee, covering payment processing and service charges, is deducted from the final sale price upon completion of a transaction.
- Payout Fee: A $4 fee is applied to each payout transferred to your account.
4. Seller Responsibilities
Sellers must ensure that all items listed are authentic, accurately described, and available for delivery upon sale. Misrepresentation or listing items without possession or the legal right to sell is strictly prohibited. If a seller fails to transfer ownership of a costume or does not remove a ticket listing after it has been sold outside of My Carnival Match, an Obligation Fee of $20 will be debited from the seller's bank account.
5. Buyer Responsibilities
Buyers are responsible for reviewing item descriptions and terms before making a purchase. All sales are final unless otherwise specified by the seller or required by law.
6. Refund Guarantees
In accordance with New York Arts and Cultural Affairs Law Section 25.07, resellers are required to provide full refunds to purchasers under the following conditions:
Event Cancellation: If the event for which the ticket was purchased is canceled.
Admission Issues: If the ticket does not grant the purchaser admission to the event, which may include reasons such as the ticket being counterfeit, previously used by another person, or otherwise invalid.
Refunds must include the full amount paid by the purchaser, including all fees. Sellers are obligated to process refunds within ten business days of receiving a request from the purchaser.

7. Prohibited Activities
Users are prohibited from:
- Listing counterfeit or unauthorized items.
- Engaging in fraudulent activities or misrepresentations.
- Using automated means to interact with the platform.
- Violating any applicable laws or third-party rights.
8. Marketing and Promotions
By using My Carnival Match, you consent to receive marketing communications, including email campaigns, Instagram posts, and SMS blasts, related to your listings and our services. You can opt-out of these communications at any time.
9. Chargeback Protection
We offer chargeback protection to ensure worry-free transactions. In the event of a dispute, users agree to cooperate with our resolution process.
What Happens If a Fraudulent Transaction Occurs
When a payment undergoes 3D Secure authentication, the liability for certain fraudulent disputes may shift from the merchant (i.e., you, the seller, and the platform, My Carnival Match) to the card issuer. This means that for transactions authenticated through 3D Secure, the responsibility for fraud-related costs can transfer to the card issuer, provided specific conditions are met. However, it's important to note that this liability shift is subject to the card network's rules and may not cover all types of chargebacks. Therefore, while 3D Secure authentication enhances security and can reduce liability for fraudulent transactions, it does not entirely eliminate the risk. .

By utilizing My Carnival Match, you acknowledge and accept the terms outlined in this section regarding chargeback protection and the handling of fraudulent transactions.
10. Limitation of Liability
My Carnival Match acts solely as an intermediary between buyers and sellers. We are not liable for any direct or indirect damages arising from transactions conducted through our platform.
11. Amendments
We reserve the right to modify these terms and conditions at any time. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of the revised terms.
12. Governing Law
These terms and conditions are governed by the laws of the State of New York. Any disputes arising from these terms shall be resolved in the courts of New York.
